Germany to Judge America?

After the US resurrected and rebuilt the nation that gave the world Hitler and slaughtered six million Jews and, approximately a quarter million Gypsies (or Roma), Germany's top prosecutor is seeking to file criminal charges against U.S. Secretary of Defense Donald Rumsfeld, AG Alberto Gonzales, erstwhile CIA chief George Tenet, and other top U.S. armed forces and civilians for alleged abuses at Guantanamo Bay (Cuba) and Abu Ghraib (Iraq). If this nation with arrogated "universal jurisdiction" tries to try any of the aforementioned American public servants, then, perhaps, the U.S. should withdraw all of its forces and tell Putin that his regrets about East Germany leaving the Russian orbit are well founded. Let Germany coalition with Chirac and his fellow French fighters.

Amen, James!  This is the fruit of the liberal press's fixation on Abu Ghraib with the intent to hurt the Bush administration.   Perhaps we should relocate our troops to countries that might appreciate our presence (like Japan or Taiwan --China would love that!)

Hey, did you hear who the NYT was speculating could be the US delegate to the UN?  Lincoln Chafee!  By going after Bolton, the Dems are making a big mistake, and conservatives should fight them tooth and nail.

Or, maybe, strengthen our Iraq presence. To give Chafee any position in the  admiistration would be absurd: he is already dissing his Republican affiliation. As to Bolton, I don't believe that he'll get through the Senate confirmation process: Bush will probably have to give Bolton another recess appointment.

Gentlemen, the German President is currently a conservative(for Germany, at least).  I think that Michelle Malkin is right that we needn't jump to any hasty conclusions:

Before you go ballistic on Germany

Yes, yes, I know, there's a big siren up at Drudge over Time magazine's exclusive on a lawsuit being filed against Don Rumsfeld over "prison abuse."

The German government isn't filing the lawsuit. It's 11 Iraqis and a Saudi who went court-shopping and filed in Germany because the country "provides 'universal jurisdiction' allowing for the prosecution of war crimes and related offenses that take place anywhere in the world." A previous lawsuit was filed on similar grounds and was dismissed. Yes, Germany has its share of weasels. But German Chancellor Angela Merkel isn't one of them and outrage at the country is premature. Calls to close our bases in Germany over this hyped news story are, with all due respect, silly.

The lawsuit hasn't even been filed yet. The Time blurb is a Friday afternoon freebie press release for the left-wing Center for Constitutional Rights--milking Rumsfeld's resignation for all the publicity they can get.

"IF this nation with arrogated "universal jurisdiction" tries to try any of the aforementioned American public servants, then, perhaps, the U.S. should withdraw all of its forces" [caps added for emphasis]: I'm not ready to pull the troops out yet. However, I believe that this is another attempt to bring Americans under an international court of justice since we would not sign the treaty to create one. (Kissinger will not even set foot in Brussels for fear of being subject to their "universal jurisdiction.") Even though Merkel is no Shroeder, she is in a coalition government that depends upon a partner that has much anti-American sentiment.

According to Judge Andrew Napolitano on "The Big Story with John Gibson" today, two lawyers in NYC filed a 181-page complaint against Secretary of Defense Donald Rumsfeld, alleging torture in Iraq, Afghanistan, Cuba, Saudi Arabia, Egypt, and Khazakhstan and want to try it in Germany. He said that German prosecutors have had this complaint for two years and are seriously considering indicting him. He added that if Rumsfeld is any European Union country that (if indicted) he will be picked up a la Pinochet.   The issue is a serious one: if America does not stand up for those who serve as public servants, soldiers, and mere citizens, then she will will kneel to those who will impose their will on her.
